Privacy Policy

This policy applies to the Sunwake iPhone app (on the App Store as “Sunwake: Sunrise Alarm Clock”, in Germany “Sunwake: Lichtwecker”) and to this website. It tells you which data the app processes, where it goes and what rights you have. Help with the app is on the support page.

3.Principle

Sunwake works without a user account and without servers of our own. The app sends no data to us. It contains no analytics, advertising or tracking tools, and Sunwake does not track you across apps and websites owned by other companies. There is no automated decision-making and no profiling (Art. 22 GDPR).

You can use Sunwake without providing any personal data. Location is optional. Without it the sky stays clear, and your alarm still rings.

4.Data that stays on your iPhone

Sunwake stores on your iPhone:

After 24 hours Sunwake no longer uses the weather cache and deletes it the next time you open the app. It deletes it earlier as soon as the app notices that you have withdrawn access to your location or chosen another place. Sunwake does not send this data off your iPhone, and we have no access to it. If you have backups switched on, it can be part of your iPhone backup, for example in iCloud; Apple’s privacy policy applies to that.

The legal basis is Section 25(2) no. 2 TDDDG (German Telecommunications Digital Services Data Protection Act), because storage is strictly necessary for the features you asked for, and Art. 6(1)(b) GDPR.

5.Alarms (Apple AlarmKit)

Sunwake sets its alarms through AlarmKit, a feature of iOS. They run on your iPhone and ring even when the app is closed. iOS asks once whether Sunwake may set alarms. You can change this permission at any time in the iOS Settings for Sunwake. No data is sent to us.

6.Real sky: approximate location and Apple Weather

When: Only if you have purchased Sunwake Pro or use the free trial and “Real sky” is on. Each alarm has its own switch. Then there are two options: you allow Sunwake access to your location in the iOS dialog, or you choose a city by hand under “Choose place”. Without Pro or the trial, Sunwake never asks for your location and never loads weather. As long as you don’t share your location, Sunwake only uses the coordinates of the city you chose; no location permission is needed for that. If you share your location, it takes precedence, and the city is no longer used (it stays stored). If you have already shared your location or chosen a city, Sunwake turns on the real sky for your alarms after a purchase or when the trial starts; you can switch it off again for each alarm.

What: Sunwake only asks iOS for your approximate location and additionally rounds it to about one kilometre. For a city chosen by hand, it uses that city’s coordinates, also rounded to about one kilometre. The app sends this rounded location and the time span the weather is needed for (the coming night and daily values for a few days before and after it) to Apple’s weather service (WeatherKit). Sunwake loads the weather when the night starts, again about 90 minutes before the sunrise, and during the day for the next 30 hours when you edit an alarm with “Real sky” on.

Why: So that the morning scene matches the weather where you are (clouds, rain, snow, fog), the moon rises and sets at its real times and the landscape follows your season. The weather only changes the scene, never the screen brightness.

Recipient: Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA. For users in the European Economic Area, Apple names Apple Distribution International Ltd., Hollyhill Industrial Estate, Hollyhill, Cork, Ireland. According to Apple, the location is used only to provide weather forecasts, is not associated with data that identifies you and is not tracked between requests. Where data is transferred to the USA, Apple states that it relies on the European Commission’s Standard Contractual Clauses (Art. 46(2)(c) GDPR). Apple’s privacy policy: apple.com/legal/privacy

Legal basis: Sunwake sends the place, meaning your location or the city you chose, to Apple Weather because you expressly want to use the “Real sky” feature (Art. 6(1)(b) GDPR). Reading your location on the iPhone is strictly necessary for this (Section 25(2) no. 2 TDDDG); iOS asks you first in its own dialog.

Choose place (Apple Maps): If you tap “Choose place”, Sunwake sends the search text you type to Apple Maps (MapKit) to find matching cities and the coordinates of the city you choose. For technical reasons Apple receives your iPhone’s IP address. Recipient: Apple (as above). Legal basis: Art. 6(1)(b) GDPR, because you start the search yourself. Only type the name of a city, not an address.

Switching off: Switch off “Real sky” in every alarm, and Sunwake stops loading weather and sends neither your location nor the coordinates of a chosen city. You can withdraw access to your location at any time in the iOS Settings under Apps, Sunwake, Location (“Never”). Sunwake then deletes the weather cache as soon as the app notices; if you chose a city, Sunwake uses that city again while “Real sky” is on. After 24 hours Sunwake no longer uses the weather cache anyway and deletes it the next time you open the app.

7.Apple Weather mark

While you use the real sky, Sunwake shows the Apple Weather mark and the “Other data sources” link below the switch in the alarm, as Apple requires for weather data. In the morning Sunwake shows the mark together with the note “Weather data: Apple Weather, simplified for the scene.”, also as a link to Apple’s page with the data sources. Sunwake loads the mark from Apple’s servers. For technical reasons Apple receives your iPhone’s IP address, as with any request on the internet. If you tap one of these links, a page by Apple opens in your browser.

Independently of this, Settings > Legal has the link “Weather Data Sources”, which opens Apple’s page in your browser. It is there for everyone, also without Pro and without “Real sky”.

The legal basis is Art. 6(1)(f) GDPR. Our legitimate interest is to display weather data the way Apple’s terms require.

8.Purchases and free trial

Sunwake Pro (a one-time purchase) and the free 7-day trial are handled entirely by Apple through the App Store: payment, billing, Family Sharing and refunds. We receive no payment details, no name and no email address. On your iPhone, Sunwake only checks the purchase records signed by Apple to unlock Pro and to work out when the trial ends. When you tap Restore Purchases, the app asks the App Store for your previous purchases.

The legal basis is Art. 6(1)(b) GDPR. Apple’s privacy policy applies to processing by Apple.

9.App Store, statistics and crash reports

Downloads and updates run through the App Store under Apple’s responsibility. Apple gives us aggregated statistics, such as the number of downloads and purchases per country; they do not identify you.

Apple only passes on crash reports and usage data if you have switched on “Share with App Developers” in the iOS Settings under Privacy & Security, Analytics & Improvements. They contain no name and no contact details. You can switch this off there at any time. The legal basis is Art. 6(1)(f) GDPR; our legitimate interest is to find and fix bugs in the app.

10.Contact by email

If you write to us, we use your email address and the content of your message only to reply. The legal basis is Art. 6(1)(b) GDPR if it concerns the app or a purchase, otherwise Art. 6(1)(f) GDPR.

Our mailbox is hosted by Gmail (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland). Google may also process data in the USA; Google LLC is certified under the EU-US Data Privacy Framework. We delete messages once the request is settled and no legal retention period applies.

11.Retention and deletion

The data on your iPhone stays until you change or delete it in the app. A city chosen by hand stays stored until you choose another place or delete Sunwake. If you delete Sunwake, iOS removes the app and all its data from your iPhone, including alarms, settings, the chosen city and the weather cache. Your purchases stay stored with Apple and can be restored after reinstalling. After 24 hours Sunwake no longer uses the weather cache and deletes it the next time you open the app.

12.Your rights

Under the GDPR you have the right to:

Right to object (Art. 21 GDPR)

Where we process data on the basis of Art. 6(1)(f) GDPR (the Apple Weather mark, crash reports, email, this website), you can object to this processing at any time on grounds relating to your particular situation. We then no longer process the data, unless we can demonstrate compelling legitimate grounds that override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims. An informal email to werraweb@gmail.com is enough.

An informal email to werraweb@gmail.com is enough. Because we do not store data about you on servers of our own, we usually cannot identify you (Art. 11 GDPR). You can change or delete the data on your iPhone yourself at any time.

This website (sunwake-app.pages.dev) consists of static pages that Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA, delivers through Cloudflare Pages. When you open a page, your browser sends data to Cloudflare’s servers for technical reasons: your IP address, the date and time, the page or file requested and the status returned, the referring address if your browser sends one, and the browser type and operating system.

Cloudflare processes this data to deliver the pages and for security and abuse prevention, as our processor under a data processing agreement and the European Commission’s Standard Contractual Clauses; Cloudflare is also certified under the EU-US Data Privacy Framework. Cloudflare keeps the data only as long as these purposes require; we do not analyse or archive it, build no profiles and never combine it with data from the app. The legal basis is Art. 6(1)(f) GDPR; our legitimate interest is operating the website securely and reliably. This website sets no cookies, stores nothing in your browser, loads no fonts, scripts or content from other providers and contains no analytics or tracking tools. Links to the App Store lead to Apple’s pages, where Apple’s privacy policy applies.

In Safari on iPhone and iPad the site shows an app banner by Apple; for this, Safari fetches information about the app from Apple, and Apple receives your device’s IP address. The legal basis is Art. 6(1)(f) GDPR; our legitimate interest is pointing to the app on the App Store.

If Sunwake changes in a way that processes other data, we will update this policy. The version published here applies. If the German and English versions differ, the German version prevails.
